The following Terms of Service ("TOS") contain the terms and conditions that govern your ("the client") use of the Web Site, YCP service ("the service") and Your China Pals ("Pals"). The TOS describe the client's rights and responsibilities and what the client can expect from the the service. You must agree to the TOS to use this service.

YCP reserves the right to add, delete and/or modify any of the terms and conditions contained in this TOS, at any time and in its sole discretion, by posting a change notice or a new agreement on the YCP Web site.

Privacy

First and foremost, we will NOT sell, spam or in anyway molest the client's e-mail or contact information. YCP understands that privacy is important to you, because it is for us as well. The client does, however, agree that YCP may monitor, edit or disclose your personal information, including the content of your emails, if required to do so in order to comply with any valid legal process or governmental request (such as a search warrant, subpoena, statute, or court order).

Legal

The YCP promise of service extends to that outlined on this Web page. YCP and Pals will be completely held harmless in the event dealings (business or otherwise) do not have the outcome the client expected. All translation/interpreting services are given on a guidance basis, and should not be used in place of legal or business advice/translation.

You agree to hold harmless and indemnify YCP, and its subsidiaries, affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, YCP will provide you with written notice of such claim, suit or action.

Health & Safety

At no time will the client proposition Pals with any inappropriate or sexual behavior. If Pals feel threatened in any way, an immediate termination of the service agreement between YCP and the client will result. No refund will be given and legal action may be pursued.

As part of the service, YCP agrees a limited responsibility for guidance and assistance. However, this responsibility only extends so far as the services on this site indicates. Though Pals agree to assist the client, they are in no way responsible for the client's health and safety.

Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT: YOUR USE OF YCP IS AT YOUR SOLE RISK. YCP (AND ANY AND ALL CONTENT AND SERVICES) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YCP EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. YCP MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR EXPECTATIONS, OR WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE (though we will do our darndest!).
